Terms and Conditions

Welcome to Customyogaplan. These Terms and Conditions govern your access to our website, your enquiries and your purchase of personalised yoga training planning services. By placing an order, you acknowledge that you have had the opportunity to review these terms before confirming your purchase.

Please read these terms carefully before proceeding.

1. About Our Services

Customyogaplan provides personalised yoga training plans based on the customer’s stated preferences, experience, available time and agreed requirements.

Depending on the selected service, the agreed deliverables may include session schedules, suggested posture sequences, practice frequency and progression guidance. The precise scope of each order will be confirmed in writing before work begins.

Our services are intended for general yoga practice and personal fitness activities. They are not a substitute for individual advice from an appropriately qualified healthcare professional.

2. Quotations and Order Confirmation

Customers are invited to submit an enquiry to request a quotation. Before an order is confirmed, we will discuss the requested service, expected deliverables, estimated completion time and total fee.

An order will be treated as confirmed when the service scope and applicable charges have been agreed, the required deposit has been received and confirmation has been provided.

Any quotation will remain valid for the period stated in the quotation. If no validity period is specified, please contact us to confirm whether the quotation remains available before making payment.

3. Deposit and Remaining Balance

The amount displayed on each service page is a deposit only and does not represent the full service fee.

The payment arrangements are as follows:

  1. The customer submits an enquiry and receives a quotation.
  2. Both parties confirm the requested service, total fee, deposit and remaining balance.
  3. The customer pays the agreed deposit to initiate the order.
  4. We prepare the agreed materials and complete the work within the confirmed scope.
  5. The customer pays the outstanding balance according to the agreed payment terms.

The full service fee, deposit amount, remaining balance and applicable payment deadlines will be disclosed before the customer commits to the order.

The deposit will be credited towards the total service fee. It is not an additional charge on top of the quoted total.

Where an order is cancelled or withdrawn, any refund or amount payable will be determined in accordance with the applicable cancellation terms and mandatory consumer protection legislation. Nothing in these terms removes a customer’s statutory entitlement to a refund where one is required by law.

4. Customer Responsibilities

Customers are responsible for providing accurate information relevant to the requested service, reviewing the quotation and communicating their preferences clearly.

Customers should inform us promptly of any material changes to their requirements that may affect the agreed scope or completion schedule.

We may request clarification where the information supplied is insufficient to prepare the agreed deliverables. If necessary information is delayed, the completion schedule may need to be adjusted. Any material change to the agreed timeframe will be communicated to the customer.

Customers should review the agreed service details before authorising payment.

5. Service Preparation and Delivery

Each service is prepared according to the requirements agreed for the individual order.

The expected delivery date, delivery format and scope of work will be confirmed during the quotation process. We will make reasonable efforts to complete the agreed work within the confirmed timeframe.

If circumstances arise that materially affect delivery, we will notify the customer and discuss an appropriate revised arrangement.

The customer is responsible for reviewing the delivered materials and notifying us of any discrepancy between the agreed scope and the materials received.

6. Changes to an Order

Requests to change the agreed scope, add further sessions or request additional revisions must be submitted by email.

We will assess the requested changes and explain any effect on the total fee or completion schedule before undertaking additional work.

Changes will take effect only after both parties have agreed to the revised arrangements. Customers are not required to pay for additional work that has not been agreed.

This section does not restrict any statutory rights relating to cancellation, withdrawal or remedies for services that do not conform to the contract.

7. Cancellation and Withdrawal

Customers may request cancellation by emailing plan@customyogaplan.com and providing their order reference, where available.

For consumers in the European Union or European Economic Area, statutory withdrawal rights may apply to distance service contracts. Where applicable, the usual withdrawal period is 14 days from the conclusion of the contract, subject to the relevant legislation and any applicable exceptions.

If a customer expressly requests that work begin during the withdrawal period, the applicable requirements concerning that request and any acknowledgement of the consequences will be followed. Where a customer validly withdraws after performance has begun, any amount payable for work already performed will be determined in accordance with the applicable law.

Where the service has been fully performed, any loss of a statutory withdrawal right will apply only where the relevant legal requirements have been satisfied, including any required prior express consent and acknowledgement.

For customers in Mexico, cancellation and refund requests will be handled in accordance with applicable Mexican consumer protection legislation and the agreed service terms.

Further information is available in our Cancellation and Refund Policy. If the provisions of that policy conflict with mandatory consumer rights, the applicable statutory requirements will prevail.

8. Refunds

Refund requests will be assessed according to the order status, the work performed, the terms agreed before purchase and applicable legislation.

Where a refund is due, it will be processed within the period required by applicable law. Refunds will ordinarily be made using the original payment method unless another method is lawfully agreed.

A deposit will not automatically be treated as forfeited merely because an order is cancelled. Any deduction or payment for work already performed must have a lawful basis and comply with applicable consumer protection requirements.

Nothing in this section limits a customer’s rights in relation to a service that has not been supplied as agreed.

9. Pricing and Currency

Prices displayed on service pages identify the deposit payable towards the relevant service. They are not representations of the full service fee.

The quotation will state the total price and any outstanding balance before the order is confirmed. Applicable taxes and other mandatory charges will be disclosed where required.

Customers should review the final quotation and order confirmation carefully before making payment. Any later price adjustment must be communicated and agreed before additional charges are incurred.

10. Appropriate Use of Our Services

Customers agree to use the supplied training plans for their intended personal practice and to follow the agreed service terms.

Yoga practice should be approached according to an individual’s experience and physical circumstances. Customers should discontinue an activity that causes discomfort and seek appropriate professional advice where necessary.

We do not represent that an individual plan will produce a particular physical result. Individual experiences may vary according to factors outside the scope of the service.

11. Intellectual Property and Permitted Use

Materials supplied as part of an order may be used by the customer for personal practice, subject to the agreed service terms and applicable law.

Unless otherwise agreed in writing, customers must not reproduce, redistribute, resell or commercially exploit the supplied materials as a separate product or service without the relevant permission.

Nothing in this section affects rights that cannot lawfully be restricted under applicable legislation.

12. Liability

We are responsible for providing the agreed services in accordance with the contract and applicable law.

To the extent permitted by law, we are not responsible for losses arising from inaccurate information supplied by the customer, unauthorised changes made to delivered materials or use of a training plan in a manner materially different from the agreed purpose.

Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, wilful misconduct where relevant, or other liabilities that cannot lawfully be excluded.

No provision in these terms removes mandatory consumer rights or remedies available under applicable legislation.

13. Complaints and Dispute Resolution

Customers who have a concern about a quotation, payment, delivery or service outcome should contact us at plan@customyogaplan.com, providing the order reference and a description of the issue.

We will review the information supplied and respond within a reasonable period. Where appropriate, we will discuss a practical resolution in accordance with the agreed service terms and applicable law.

Consumers may also refer a matter to a competent consumer protection authority or other dispute resolution body where entitled to do so under applicable legislation.

14. Privacy

Personal information submitted through our website or during the ordering process will be handled in accordance with our Privacy Policy and applicable data protection legislation.

Customers should consult the Privacy Policy for details of the information collected, the purposes of processing, applicable retention arrangements and the procedures for exercising privacy rights.

15. Governing Law and Consumer Rights

These terms are governed by the laws applicable to the relevant contractual relationship, subject to mandatory consumer protection rules.

Where a consumer ordinarily resides in an EU or EEA country and applicable law grants that consumer mandatory protections, a choice of governing law will not deprive the consumer of those protections.

Nothing in these terms restricts the right of a consumer to bring a claim before a court that has jurisdiction under applicable law.

16. Amendments to These Terms

We may update these terms to reflect changes in our services or applicable legal requirements. The current version will be published on our website with its revision date.

The terms applicable to an existing order will be determined by the agreement made at the time of purchase, subject to any subsequent changes agreed by both parties and any mandatory legal requirements.
